Legal & Policy Framework

These documents together form the contractual relationship between D-SERV ("we", "our", "the Company"), and the Client ("you", "your"). By using our services, you agree to all the documents below.
1 Terms of Service (ToS)
The ToS is the main contract. It covers:
- Services offered: Hosting, SaaS, Game Development, Modding, and Design.
- Account & payments: Clients must provide accurate details, keep accounts secure, and pay invoices on time.
- Term & termination: Contracts are valid until cancelled.
We may suspend or terminate accounts for:
- non-payment;
- breach of ToS, AUP or law;
- abuse of services.
- Client responsibilities: You are solely responsible for the content, use, and compliance of your services.
Violations: If you breach these terms, D-SERV may suspend or terminate services immediately, without refund or further liability.
Third-Party Games & Intellectual Property (Hosting)
D-SERV may provide infrastructure and services for hosting or operating servers for third-party video games. All video games, game engines, and related software hosted, supported, or made accessible through D-SERV services remain the exclusive intellectual property of their respective developers, publishers, and rights holders.
D-SERV does not claim ownership of third-party games and does not grant any rights or licenses to such games beyond those expressly permitted by the applicable rights holders. The Client is solely responsible for ensuring that their use of any hosted game server (including game files, configurations, mods, plugins, maps, or other related content) complies with the relevant end-user license agreements (EULA), publisher/developer terms, and applicable intellectual property laws.
Nothing in these Terms shall be construed as granting any ownership, license, or rights in or to any third-party video game beyond those expressly permitted by the applicable rights holders. D-SERV reserves the right to suspend or terminate services immediately if it receives a complaint, notice, or reasonable belief that a hosted service infringes the intellectual property rights of a third party.
2 Service Level Agreement (SLA)
- Hosting & SaaS uptime: 99.9% availability measured monthly.
- Downtime definition: Periods when the service is unavailable to all users due to server-side faults.
- Exclusions:
- Force majeure (natural disasters, government action, war, etc.);
- Maintenance windows (with notice);
- Failures caused by client software, configuration, or misuse.
- Compensation: Eligible downtime may be compensated with service credits only (no cash refunds).
- Development / Modding / Design: Delivered project-based. SLA does not apply.
3 Privacy Policy
Compliant with UK GDPR. Covers:
- Personal data collected: account details, billing information, server logs, project files.
- Use: service provision, billing, and security.
- Storage & retention: data kept only as long as necessary for legal or contractual purposes.
- Sharing with third parties: payment processors (PayPal, Revolut, banks), infrastructure providers (data centres, cloud vendors).
- Client rights: access, correction, erasure, portability, complaint to ICO.
- Confidentiality: All custom development, design, and project files remain confidential.
4 Refund Policy
- Hosting & SaaS: Refunds issued as account credits only.
- Custom Work: (Development, Modding, Design): Non-refundable once started, since time and expertise are consumed.
- SLA compensation: Issued only as service credits.
- Exclusions: No refunds in cases of non-payment, breach of ToS/AUP, or termination for illegal/abusive use.
5 Acceptable Use Policy (AUP)
Prohibited activities include (but are not limited to):
- Illegal content or activity (piracy, fraud, distribution of copyrighted or unlawful materials).
- Network abuse: spam, flooding, DDoS, botnets, brute force, scanning, mass unsolicited communications.
- Malicious software: malware, ransomware, crypto-mining, trojans, exploits.
- Resource abuse: excessive usage affecting others' performance.
- Misuse of custom work: resale, distribution, or reverse-engineering of code, panels, or designs without consent.
- Use of hosted game servers or related services in violation of the applicable game developer’s or publisher’s license terms, end-user license agreements (EULA), or intellectual property rights.
Violation of the AUP may result in immediate termination of services in D-SERV's sole interest, with no refund and no liability.
6 Data Processing Agreement (DPA)
Required for compliance when we process client data.
- Roles: Client = Controller, D-SERV = Processor.
- Data covered: account data, hosting logs, project files for development/design.
- Security measures: encryption, access controls, monitoring.
- Retention & deletion: data is erased upon contract termination or expiry of legal retention period.
- Sub-processors: PayPal, Revolut, banks, infrastructure/data centre providers.
- Breach handling: We will notify you of any confirmed data breach within the legal timeframe. Liability for breaches caused by upstream providers is passed to those providers.
7 Definitions
Refund
Return of funds or credits to the client.
Downtime
Period when hosting/SaaS service is unavailable due to server-side failure.
Service Credits
Non-cash credits applied to your D-SERV account for future invoices.
Illegal activity
Any action prohibited under UK law or the laws of the client's jurisdiction.
